These Terms of Service (“Terms”) govern your use of the Samildanach Arts website and the purchase or use of any products or licences made available through it.

By accessing this website or purchasing a licence, you agree to be bound by these Terms. If you do not agree, you must not use this website or purchase any products.

1. About Us

Samildanach Arts provides licensed performance works for schools, educational settings, and theatre productions.

Samildanach Arts operates as a licensing and distribution entity for original dramatic works.

2. Products and Services

All products sold through this website are performance licences, not physical goods or instant digital downloads.

Unless otherwise stated:

  • No physical items are shipped

  • No automatic downloads are provided

  • Licensed materials are issued manually by email following order review

Each product description forms part of these Terms.

3. Licence Grant

When you purchase a licence, you are granted a limited, non-exclusive, non-transferable licence to use the specified work under the conditions stated on the product page.

Unless explicitly stated otherwise, licences are:

  • Valid for one named school or organisation

  • Valid for one academic year

  • Limited to the use type described (school or theatre)

No ownership or intellectual property rights are transferred.

4. School Performance Licences

School licences typically include:

  • Unlimited rehearsals

  • Unlimited in-school performances during the licence term

  • Use only within the named school or educational setting

Public, ticketed, or commercial performances outside the school setting are not permitted unless explicitly stated.

5. Theatre Performance Licences

Theatre licences are issued separately and are:

  • Priced per production

  • Based on venue type, run length, and audience size

  • Issued following direct agreement

A school licence does not grant theatre performance rights.

6. Intellectual Property

All scripts, performance works, written materials, and related content made available through this website are protected by copyright.

All intellectual property is owned by Lughstone Holdings Limited, a company currently in the process of registration.

Until registration is formally confirmed, all rights are held in trust for Lughstone Holdings Limited by its appointed director.

Samildanach Arts acts solely as the licensing and distribution entity and does not claim ownership of the intellectual property.

No ownership, authorship, or publishing rights are transferred through the purchase of a licence.

Unauthorised copying, redistribution, recording, publication, adaptation, or commercial exploitation is strictly prohibited.

7. Delivery of Licensed Materials

Licensed materials are delivered by email as PDF files following manual order review.

Delivery typically occurs within 24 hours, but timing is not guaranteed.

Failure to provide a correct email address is the responsibility of the purchaser.

8. Returns and Refunds

Because products sold are licences, all sales are final once a licence has been issued.

Refunds will not be provided after delivery except where required by law.

If a licence has not yet been issued, refund requests may be considered at the sole discretion of Samildanach Arts.

9. Acceptable Use

You agree not to:

  • Share licensed materials outside the licensed organisation

  • Record or distribute performances without written permission

  • Use the works in a way that breaches safeguarding, licensing, or educational standards

  • Misrepresent the nature or ownership of the works

Breach of licence terms may result in immediate termination without refund.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Samildanach Arts shall not be liable for indirect or consequential loss

  • Use of licensed materials is at your own risk

  • Responsibility for supervision, safeguarding, and compliance rests with the licensee

11. Changes to These Terms

These Terms may be updated at any time.

The version in force at the time of purchase will apply to that purchase.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Ireland.

Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.
